The Transfer Tax (ITP) is the tax paid by the buyer of a property that is going to be resold. This tax is under the jurisdiction of each autonomous community and the tax rate is applied to the real value of the property. The Stamp Duty (AJD) is a tax applied to acts formalised through a deed that is signed before a Notary Public and registered in the Land Registry, and they involve a consideration, such as the amount paid for sale of a property.

The ITP and AJD is calculated based on the real value of the property. However, the Tax Agency may disagree with the value you’ve submitted so you may have to file an appeal and provide an opposing expert valuation that proves that the value you submitted does indeed match the real value of the property at the time of the transfer.
